Civil Penalties and Appeals

The Home Office is able to issue Civil Penalties (and criminal Penalties) to employers whose personnel records do not adequately reflect the requirements of the Prevention of Illegal Working Code of Practice. This requires that you as employers check your employee’s documents with specified regularity. Failure to comply can lead to a fine of up to £10,000 per employee who does not have a right to work.

If your business is visited and one or more Civil Penalties is issued, we can advise you on whether you are able to raise a statutory defence.

We can also assist with challenges to the penalties issued, whether by way of written representations to reduce the amount of the penalty or representation at a statutory appeal.
