Changes To Housing Act (1988) Notices

Changes From April 6 this year will see an update to the Housing Act 1988. Regulations passed by the government will soon come into force that revoke and replace the current regulations on statutory notices.

Housing Act Changes

The section 13 procedure which deals with rent increases, and the section 8 provision on notices seeking possession will be affected by the changes. These changes are taking place to fall in line with the new additions in October last year that introduced new grounds for possession under 7A and 14ZA.

Landlords Take Note

It is important that landlords are aware of these changes as any notices from April 6 will need to be in line with the amended regulations.

The key change is that the prescribed forms used in serving the notice are changing. If a notice is served using the wrong prescribed form after this date then there is a risk that the notice will be invalidated by the Court. Any notices served before the regulations come into force in April will still be valid.

The changes to notices will only come into effect in England, with the regulations in Wales remaining unchanged.
